What you are buying

A revocable living trust holds assets during your life and passes them to your beneficiaries afterwards; you can change or cancel it while you are alive. Online trust plans usually bundle a pour-over will, which sends anything left outside the trust into it.

Prices. Trust & Will's Trust Plan is $499 for one person and $599 for a couple, and includes the trust, a pour-over will, HIPAA authorization, an advance healthcare directive, a power of attorney, a schedule of assets and a certification of trust1. LegalZoom's Basic trust is $399 and Premium $549 for one person ($499 and $649 for couples); Premium adds a year of attorney consultations that renews at $199 a year2.

Signing. Trust & Will says notarization is required for most living trusts1. LawDepot's steps: sign in front of a notary, and if someone other than you is trustee, that person signs too3.

LegalZoom warns that titled assets must be legally transferred to the trust, or the estate goes through probate2.

    Record a new deed in the trust's name. Budget for any county recording fees.

  • Bank and brokerage accounts

    Retitle them into the trust with each institution2.

  • Retirement and life insurance

    These pass by beneficiary designation, not through the trust.

  • Signing

    Sign before a notary; a trustee other than you signs too3.

Trust questions

Do I still need a will if I have a trust?

Trust plans include a pour-over will for assets left outside the trust12. It also lets parents name a guardian for minor children, which a trust does not do.

Is a trust worth it for a small estate?

It depends on your state's probate thresholds and what you own. California, for example, lets heirs collect personal property without probate below a set value. See will or living trust.
